My husband stepped off of a ladder wrong at work and ended up witha plate, 6 screws and 2 pins in his lower leg...his employer rushed out the next day and put him on Workers Comp (thanks)...but says after that she feels it is not her problem that he will be out of work for at least six months and we have no income coming in and two kids. That our problem she said... Now my question can we sue?
Of course you could sue, but if he is on workers comp he will recieve his pay from the workers comp ins company untill he is completely well and back to work. Since that is what workers comp does, it pays for all of your medical bills, bays your salary while you are off work, and will most likely give you a settlement for a partial disability if that is the case.
If that is not what the company is doing, then you are not on real workers comp, he is only paying medical out of his pocket.
So if this is not the case, ask and contact his workers comp ins carrier and also make sure a claim was filed with the state workers comp.

To sue or not to sue. A few things to remember... If they did not provide a proper amount of safety guidelines, equipment etc, or if it was dangerous what he was doing I'd say yes, if he was not following procedure and HE Was wrong then NO. For the most part I would call a lawyer, talk over the phone for free, get the basic details, and talk fees. Call around. Remember the long term...and you can call the state on how workman's comp works and it's maximum and minimums...It's all alot of rules...best to talk to those who really know....unless someone here happens to be a lawyer and talks about the details to you- no one can say.

You are entitled to workman's comp for all the time you are out of work. If you husband has a friend at work have him get the phone number for your workers comp carrier. If not call the state unemployment office and ask them who to report this to. The law says that employers must have Workman's comp to cover their employees.

He should be able to claim long term disability under Workers Comp. Dont sue, at least in six months he will still have a job. If you sue, long term your screwed..

You can't sue your employer. You'll have to settle for workers comp until he goes back to work. If he can't go back to work then you can get a comp lawyer.
Been there, my husband is permanently disabled from an accident at work.

Talk to an attorney. Don't trust the internet. You have too much at stake to trust online "lawyers". A personal injury/employment lawyer may even give you a free consult.

Yes. If a thief can sue the owner of a building, which he was trying to rob, because he fell through the sky light/window in the cieling ,and WIN ,then by all means. YES!!!!

talk to a lawyer who specializes in workers comp. cases. Laws are different everywhere. most lawyers will consult you for free on the phone. they will let you know what your case looks like, if you even got one. sounds to me like u do. I would opt for one that doesnt get paid unless u win money.

Most attorneys offer a free consultation (for first one). Talk to different attorneys, and compare, to see whether you can or can't. Some might even have a percentage pay. no money up front, they get a percentage of settlement.............J
