I believe they have the right to request that accomodation. For that matter, an atheist should be able to request simply pledging to tell the truth without the use of the Bible.

No one is asked to place their hands on a bible these days, and they even accommodate those who feel it's a sin to swear using God's name. (Swear not, but let your yes be yes and your no be no--or something to that effect).

"Do you swear or affirm that the testimony you are about to give before this court will be the truth?" (If you lie under oath, it is a criminal act, and can be punished.)

Most states have laws like those in NC, which state:

Existing North Carolina statutes allow for the use of a religious oath to be sworn "with upraised hand," without the use of any religious text, and for the use of a secular oath such that the word "affirm" replaces the word "swear" and the words "so help me God" are deleted.

The modern trend is towards not invoking any religion in taking the oath. The reason behind taking the oath is to make the person testifying aware of the fact that if they perjure themselves they face criminal penalties.

they don't have anybody put their hand on the bible anymore, the practice now is to simply have you raise your right hand and then are asked "do you swear to tell the truth, the whole truth, and nothing but the truth?"

one should be made available, but then where would it stop? What would atheists/agnostics/all the other religions swear in on....our judicial system is bogus anyway....why swear in at all?
