There has been an incarceration order on him for 2 years now.. police wont pick him up and DHS wont make them. I have to send them over to his house every other weekend and he owes $7284 in child support. Why am I in contempt of court if I don't let them go?

Our system for collecting child support from deviant fathers is a mess and needs restructuring so badly. I was educated, with a good job, did not depend on the system for any support, and went to the child support division with all the information they needed to get the guy - and they didn't do squat! They kept telling me they 'couldn't find him" and I was talking to him every week. We had no beef - but I needed him to provide more than he was willing to send. Yet - a friend, who was on support, getting food stamps, section 8 rental, and eveything else 'free' for her children - they sent out the militia looking for this creep! I began to understand how the system works - if you are getting money from them - they will work and find that dead beat dad to get their money back - but if you are hardworking and support your own, they sit back and let you fall through the cracks, What I did was sit down with the child's father and we came to an agreement IN WRITING with both signatures and witnesses and a notary and agreed together on who was paying what and when salaries increased what that would be, who would pay for travel, etc. We kept the state out of our business and the agreement worked for 18 years - now our daughter is 20. Sometimes you have to bite the bullet and hire a personal attorney - someone who will work FOR YOU. I bet you, they will get something done. Don't give up. Your child needs the support and the way they flag your social security number - it does not matter what state you "run to", as soon as you apply and "get" the job - that child support is coming out.. Then when you file taxes - a red flag goes up and your child support will come out of that check too. Go for it. Your child deserves the best that both parents can provide.

There is a difference between child support and a child's relationship with his/her father. The police do not pick up people for child support violations, even if there is an incarceration order because the incarceration order is probably only if he is picked up for some other reason. DHS is so overloaded that they can't get everyone who owes money. However, a lawyer can get the person into court and have them jailed immediately unless they pay. They can ask the court to modify the parenting time order, get an order revoking his driver's license and, in some cases, ordering that his passport be revoked by the US State Department. A lawyer can also garnish his pay and bank accounts.

Him owing you support has nothing to do with visitation rights. If the visitation says every other weekend then that's what it is...unless you go to court and get it changed.

DHS works differently from state to state. In Washington where I live they lock dead beats up. I assume he is not working or they would be garnishing his wages.

I would stick with going through DHS as they have way more horsepower when it comes to attaching his assets and garnishment and the like. Plus their services are free.

Becasue he still has the right to see his children. I suggest you call an attorney and take him to court. A Judge can sentence him to Jail indefinatley until the child support is being paid again. They will make him go to work and return to Jail nightly he will also have to pay rent in Jail.

Because him breaking the law doesn't mean you can. If the judge ordered visitation, then you have to allow him to see his kids.

beats me but if you can do that let me know i got a deadbeat daddy that hasn't paid nothing in 13 years and he talks to his kid everyday per court order go figure
