have a family friend that has just recently found out that the child that he thought was his is not... he and his wife are now going through a divorce what right does he have to this child as far as custody in texas....(he is not named on the birth certificate as the father but the child has his last name)??? Please help!

If he is not on the birth certificate and has not taken any DNA tests or done anything else to establish his paternity of the child, he is not the legal father. He should ask for a DNA test to make sure whether or not he is the father.

If is not the father, he doesn't have to pay child support nor will he get visitation or custody.

If he wants to continue a relationship with the child, he can ask the court to allow him to continue as the father since he has been the de facto father for the child's entire life. He will have to pay support. The court may not allow this, however.

He really needs to get a lawyer, whatever he does.

WELL guess what if he did not put his name on the certificate for this child then he has no right to his or her to see this child he might gave his last name but I wud check in on it with asking a lawyer on this this depending what you find to pay him or go on the internet at the libary of congress to look on civil laws and statues wud you plz

. I had a case that I was not the childs biological father to this girl and I wanted to get out of it not paying for if she was not mine acase in point. if I had put my name in on her certificate while at the time this child was born I wud have No choice to pay child support but all in all she was my child of my flesh and blood it took a dna to find out cuz the x wife was telling this other man I knew that that this child was his daughter. and she told my daughter I WAS NOT HER REAL FATHER AT THE TIME
so it become's a issue if he gave consent to give her his last name I should think he still has a right to see her if he is willing to pay child support this a issue that needs a lot of disscussion on

Don't know the answer but I do have a suggestion for you - check your yellow pages and look for a family atty offering a free 1/2 hour consultation and go see him or her. That way you'll know for sure.
