What is the time period after your 3 day notice until you HAVE to vacate? Will they wait 6 days until you get paid if your last check was a mess-up and is still being sorted out? With extinuating circumstances would they be willing to work with me?

If you don't pay before the 3 days are up, the landlord will go to court and file for an eviction. You will then have 30 days to be out.

Your landlord will then probably sue you for the rent for the entire period for which you were in the apartment, including late fees. You will also probably lose your security deposit.

What you need to to is call your landlord immediately, and tell them that you will pay on day 6. They will probably still go to court to file for legal eviction, but if you give them ALL the money (late and current rent) owed on day 6, they might dismiss the eviction court action. If they don't, when you go to court for the official eviction (and make sure you go to court!), show the judge your receipt showing that you are have paid all past and current rent, and owe the landlord nothing at the moment.

If they accept the money when you go to pay all the late and the current rent, the eviction will be voided.

If they don't accept the money, you don't have a choice but to be out by date given to you by the court. Usually this will be 30 days after the court filing of the eviction.

And don't be late on your rent again!

no....you can try and talk to your landlord and explain the situation, but if you've gotten that notice, you're pretty much screwed. most laws protect the landlord and not the tenant. if you don't pay the rent in 3 days, most likely you will get the paperwork for an eviction notice and then you usually have 30 days to vacate.
