Spock on both counts. There are many types of intelligence.
1. Linguistic
2. Logical-Mathematical
3. Bodily-Kinesthetic
4. Spatial
5. Musical
6. Interpersonal
7. Intrapersonal
I would say Data is functional, but hasn't fully understood 1, 5, 6, and 7, but he beats Spock hands down in 2, 3, and 4. Overall, Spock in the most intelligent when considering all types of intelligence.
Also, as special envoy to the Romulans sent by the Federation, Spock would outrank Data not allowing Data to harm Spock. Plus Data is not a battle droid with any sort of battle plating or weaponry. Spock could easily defeat Data using his cunning and battle experience.

Spock, data is a machine so his intelligence is not natural. That's
logical I would say... Plus in a fight all you need to do is switch data off. There is no contest!!

Obviously Data. He's stronger, has faster reflexes, and has near-infinite knowledge.
Of course, if you wished to measure creativity, Spock would win out.

Data. He's an atificially created humanoid with the brain power of many supercomputers, plus the ability to learn and adapt. Also, physically, he's built to withstand alot of things and is at least 10x stronger than a human.
