Article II Section 4: "The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors."

Article I Section 2: "The House of Representatives shall ... have the sole power of Impeachment."

Article I Section 3: "The Senate shall have have the sole power to try all Impeachments. ... When the President of the United States is tried, the Chief Justice shall preside: And no person shall be convicted without the concurrence of two thirds of the members present.
Judgment in cases of impeachment shall not extend further than to removal from office, and disqualification to hold and enjoy any office of honor, trust or profit under the United States: but the party convicted shall nevertheless be liable and subject to indictment, trial, judgment and punishment, according to law. "

The idea of presidential immunity was clarified in Mississippi v. Johnson, 4 Wall. (71 U.S.) 475. The Court applied the separation of powers doctrine and determined that the courts could not tell the Executive what to do, while the Executive was still in office.
Impeachment can remove the president from office, and he can be subject after removal to criminal charges in federal court.

well the way i look at it is the germans were charged with the war crimes they commited while in power so what makes the united states government any different. they have done many things to people of other nations in which the rest of the world knows to be war crimes. in a perfect world yes but unfortunaly it is always the civilians who suffer.

I believe they can only if they are impeached and brought before the World Court. And if you are referring to our current president, I wholly agree that he should be charged with war crimes against the United States, but I seriously doubt it will happen, he's got too much "Good 'Ole Boy" money behind him.
