Legally speaking, an employer cannot discriminate against people for a number of reasons, ethnicity and gender being two of them. And saying Equal Opportunity Employer means that they don't legally discriminate when it comes to whom they consider for employment.

Now as far as the real world goes, discrimination does happen. For example, if I see a resume with the last name Sanchez on it, my first thought could be that you're not "American." You're Hispanic. And if it's a name I can't even pronounce, then I might question whether you can even speak English.

Can I legally discriminate by not even considering hiring you? NO! But do some employers automatically pass these people by for no reason other than their own personal prejudice? YES!

The problem really lies in the fact that unless someone calls the employer to account, they'll usually let it slide that they just didn't get the job and move on to the next one.

The EEOC does investigate employers accused of discriminatory hiring practices, but not everyone gets caught. And of course, as a job-seeker, you probably can't wait for the investigation to conclude, so you move on to the next employer hoping that this one will take you on.

FYI, when it comes to a physical or mental disability, all an employer has to legally do is provide "reasonable accommodation."
