My sister got a letter today from the IRS, saying she owe's $2,880, from the year 2002, it was addressed to her and her husband, well her husband and her have been living apart for 9 years now, he lives with his mother... They have 2 kids, she claims 1 child on her taxes and he claims the other 1 on his. Is that legal, she gets child support for both kids....1 child lives 3 months out of the year with his dad, they have never had a legal seperation, so she didnt think it was wrong, ....what can she do, ? please help.thank you

Its not back taxes that they owe, the IRS are saying they lived together and not apart, and that they should have filed as married,.BUT they havent lived together in years

You didn't specify why the IRS has assessed her the money. If she filed jointly with her husband in 2002, then she is jointly liable for any taxes due under that return, unless she filed (or files in a timely manner) an Innocent Spouse claim.

She should probably consult a tax advisor. If she looks in the phone book, she should be able to find a HR Block office that is open year around, and they will have someone who can properly review the documents and advise her on her situation.

A child has to live with you for 6 monthes out of the year in order for you to claim them. If the Irs says you own then she will have to pay unless she wants to take her husand to court and sue him . They will both have to end up paying .
