My marriage partner is not willing to file for bankruptcy, as I am. I have debt in my name that I am wanting to be expunged. I am not working, and I only have a few monthly bills (i.e. cell phone, cable) in my name.

Is it better to proceed and try to have my debt discharged, or to wait and see if he will be willing to file later down the road- together?

I filed bankruptcy before my husband and I were married because the attorney told me that he would have to be included after we married even though the debt was from previous marriage. I thought I was doing the right thing. Now when we try to get a loan, his credit score is 850+ but because of my bankruptcy I either have to be left off the loan or they say no regardless. I could not even be put on our loan to purchase a home. If your spouse thinks you two can work it out TRY!!! Getting rid of the bills does not make all the bad things go away. It's much better to just cut back on some extra spending and pay off your bills! The cell phone and cable would be the first bills to go if you are having problems making ends meet.

When you marry a person, you marry their debt, and vice-versa.
I have never heard of one partner filing bankruptcy, but then again, I have no experience in that area. I would never consider it. I worked three jobs to bail myself out of debt.
