Legally no he does not have to give anything to them. He is her heir. Morally he may want to but it isn't necessary. Fighting over money like this will destroy the family.

The kids are not entitled to anything weather they are from a former marriage or from current marriage. Community property is not defined with children in mind. If mom wanted to have an inheritance set-a-side just for those children, then she would have done so.
All the other information is irrelevant weather it be moral or legal standards. Wife's aunt made a gift to the couple, not to the kids. Wife's payments to the mortgage was for the family, not the kids who have obviously moved on and built lives of their own. If he paid for every day living expenses for those children just as if they where his own, then why would the children treat him like he owes them something. I think its sad the man can't respect the memories of his wife in harmoney with those children. If you ask me I think the children are being greedy.

dogs! that so called husband has no way of earning that money on his own efforts. but seriously find out what such husbands justify their acts with. on the contrary, if women and men were equal in all respects, being a 'man' of the house for a woman should not affect them. its like a man taking care of all expenses, running the house has changed its face. woman can also do the same. this is where woman can show their capabilities. but the wife must make sure he earns back the money within a definite time. or else he will do whatever to earn it.

No, I don't think so. Their father is still living? Biological? He should've been paying child support all of those years, and if they are really money hungry, and he didn't pay it, and their step-dad paid all of their expenses like that growing up, then they can go after their biological father. But the step-dad's house, was him and his wife's....What he does with it, or with the money from it..is up to him. Especially if the children are already grown, out of the house...and on their own. If they want money, their just gold digging, and should do it elsewhere.

Just sounds real greedy to me.
Are you suggesting this lady would have not wanted her husband to carry on with all of it and leave the money to all the children equally when he dies? Most people leave a will. If they do not then everything should go to the partner.
Why do children always seem to think they are owed money or have a right to money when a parent dies?
Cant help thinking it dishonors the parent.

No. That's his property not the kids. He supported them while they were growing up. It is his right to sell the house if he wants to. He doesn't owe the kids a penny. The kids didn't put any $$ into it, why should they profit? They need to be adults and quit sticking their noses where they don't belong. Why they think they deserve any $$ is beyond understanding.

Morally, i think he should give them some portion of her estate (maybe half is not necessary), but legally, there is no obligation unless she had a will as far as I am aware.
It also would depend on if these children were in his will, because then the money would get to them eventually.

you talk about a defense. did he do some thing wrong? if she left it to him in a will then she either thought he should have it or thought that he would give it away as best he could. if there is no will then the only thing u can do is let the courts decide
