who is responsible for removing the branches that are hiiting my house?

You can trim it, but try to get the neighbor to first.
If they don't, then cut every thing hangin past the property line.

To prevent a future problem with your neighbor I would suggest first talking to him about your concerns. If the tree is touching the house it will do damage because as the wind blows the tree moves. Chances are he will even help. If not perform the cutting yourself. Be sure to talk with your local nursery to learn correct trimming procedures for the type of tree it is. By trimming trees at the wrong time of year you can cause stress or allow disease to enter through the new wound. Using the tree paint will seal off the cut and help eliminate the possibility of damage to the tree. Seek information prior to cutting, you get to learn something you did not know and the folks at the nursery get to share their knowledge. Everyone comes out a winner even the tree. Good luck.
