The "official" policy is "One China". Meaning, Taiwan is seen as a subsidiary of mainland China (even though it is not).
This is done to appease the Chinese. (We do a LOT of business with mainland China)
But in reality, Taiwan is an independent country. It cannot declare Independence without incurring the wrath of China, however. It is only a few miles away.
So everyone just dances around the issue and pretends that Taiwan is a part of China just to be nice.

When the UN ousted Taiwan in favor of China in 1974, Taiwan's Chiang Kai-Shek refused to enter the UN under the name "Taiwan." He chose to remain his claim of all of China. So ever since, Taiwan became stateless in the UN. And gradually more and more countries shifted recognition to PRC because Taiwan's constitution today still implies that the ROC is the ruler of all China. Therefore, in order to join sport competition, Taiwan cannot enter as a country becuse the country's name would be Republic of China. If Taiwan were to change its name to Republic of Taiwan, China would probably attack Taiwan and destroy the island. So Taiwanese people are really left with no choice but accepting the name "Chinese Taipei."

It is probably Taiwan's choice. They play a very delicate game with China, trying to be as independent as possible but always having to make sure they don't go too far. China considers them a rebellious province and would seriously consider an invasion with the right provocation. One of the things China considers provocation is any talk of independence, so Taiwan has to pretend they are part of China even though no one is fooled.

Taiwan is seen by mainland Chinese as a corruption begun by Chiang Kai Shek in the late 1940s and supported by many influential and wealthy Americans...Henry Luce, et al and by the extremely wealthy T.V. Soong (one of the wealthiest men in the world at the time) and Chiang was supported by Big-eared Tu and the Green Gang who had used drug smuggling, extortion, kidnapping and murder to insure Chiang's success but finally Chiang was driven to Formosa (Taiwan today) which had previously been under the Japanese. Chiang cowed by the Japanese and even used the Flying Tigers (under Claire Chennault) to bomb his own men rather than let them be captured by the Japanese. Chiang managed to beg several billions dollars from the US by influential friends like Wilkie, Everett Dirksen, Worth Clark and Styles Bridges and maintain his corrupt regime on Taiwan (TaiPei is the capital city). Chiang had married one of T.V. Soong's sisters May-ling. Many of the refugges that fled to Taiwan went because of the conflict on the mainland and not from a feeling of loyalty to Chiang and a good percentage of the population still cling to the familial homeland of China in spite of the few generations that have passed and reunification of the Chinese people will be complete when the old hardliners have passed on. Taiwan has a population of 23,000,000 (ShangHai has a population of about 18,000,000) but the government of Beijing have no interest in an armed conflict no matter what Taipei screams...for if they want to hurt Taiwan, all they need to do is to stop buying produce from Taiwan, and for an agricultural country with few options...it would hurt the old pocket book and the war-mongers might find themselves on the outside looking into to the farmers that demanded a change. So to maintain a token control over Taiwan, Beijing insists on small things but they didn't stop the Taiwanese envoy from going to the Pope's funeral. Hong Kong and Macau were not part of the conflict between the KMT and the communists and even now some eight years after the colonies were returned to China have an autonomous government and are granted SAR (Special Administrative Region) status. The Republic of China on Taiwan is not a sovereign nation. Its true status is that of a (1) subordinate occupying power beginning Oct. 25, 1945, and (2) a government in exile beginning mid-December 1949
In the post-war peace treaty of April 28, 1952, Japan renounced the territorial sovereignty of Taiwan, but the ROC was not designated as the "receiving country." Hence, under international law, the ROC Constitution cannot be considered the organic law of the Taiwan cession, and there is no legal basis for considering Taiwanese persons as ROC citizens. (Of note is that the "Nationality Law" in Taiwan has never been updated to reflect any supposed "mass naturalization of native Taiwanese persons as ROC citizens" in the post WWII era. Importantly, when that Nationality Law was originally promulgated in 1929, Taiwan was a part of Japan.)
Without territorial sovereignty, military conscription in Taiwan by the ROC government is a violation of the Geneva Conventions. (Most researchers are unable to discuss the Geneva Conventions in terms of a territorial cession after war, because they do not know the criteria for determining (1) the occupying power, and (2) when the military occupation ends.)
Legally speaking, Taiwan is an overseas territory of the United States still under military government, however in order to do the analysis you need an in-depth knowledge of (1) the laws of war as recognized by the United States, and (2) military jurisdiction under the US Constitution.
