The courts are supposed to go by the father's tax forms and they make an amount that's fair to him and to the child. My kids father makes enough that he is supposed to pay $350 per child per month but he conveniently got that reduced to 1/2 cause he turned around and got someone else pregnant. Courts took pity on him.

As far as I'm concerned $40 per month is not enough for the cost of living for any child at any age. I'd be going back to court. Also, each year you can go for a raise to child support that takes into account for the raise of "cost per living" that government says we are entitled to.

Hope this helps you at least in the right direction. I'd be suing for more if I were you. You should get at minimum $40 per week, not per month.

Good luck!!!

your state's Department of Child Support will likely have a support calculator on their website that you can use to figure out what is fair. additionally, the child support office will help you get a court order to increase the payment amount or get a court order if you do not already have one. it may take some time, but it is free.

depending on what state you are in you need to go to the child support office and ask them to help you get support. That way you do not have to pay for an attorney and they can not force someone to work, but when he is working they can garish his paychecks, they can also get his money if he fills taxes. And you don;t have to worry about bringing him back to court, that is child supports job. Research you local child support office and good luck.

The courts determine the amount by how much the other parent makes. If you are on assistance, then talk to your caseworker and they can explain it more to you. If not, talk to legal aid about getting a lawyer to get an order of support established. Good luck:)
