it is not supposed to be legal, but it is when you get a certain amount of pay per week for 40 hours, if you work over forty hours, they divide your base pay by the total number of hours worked lets say 60 (so thats 20 hours of overtime). That gives then an hourly rate at whcch they are going to pay you for the overtime hours. Most places pay time and a half for overtime, but chinese overtime, you get much less.

You all clearly do not understand what "chinese overtime" is.
Chinese overtime is usually when you work a variable work schedule. Anytime worked over 40hrs in that work week is paid variably. Look up the Fair Labor Standards Act. it spells it out, it is completely legal. However there are situations that can occur that can make it very very illegal.
For Example:
You agree with your employer to $500 per week salary. You work an agreed salary amount based off 40 hour work week and lets say you work 12 hr shift (like most law enforcement and nurses) so the week you work 3 days your paid $600 working only 36 hrs that week and the week you work 4 days your still paid $600 even tho you worked 48 hrs that week. It becomes illegal when lets say your employer is shortstaffed, so they are make everyone work manditory overtime. so now instead of working the 3 days one week and 4 the next, your working 6 days every week. Now there is no schedule variations, nor is that $500 per week that you agreed too equal to the minimum wage. (remember, your still working 12 hr days every day, 6days*12hrs is 72hrs that week. $500 divided by 72 hrs is $6.94. That is when employers get sued.
