My biological father and I have never seen each other by his choice. I'm wondering if there is a way to legally force him to take a paternity test. I am 30 and have a baby on the way. I know nothing of his family history (ie medical history) and that could pose a risk for my child.

You could contact a lawyer and see what could be done legally - you would probably have to take him to court and have a court order to get his dna.
Have you tried talking to him and letting him know that you just want to make sure the he is your father and you just want to know his family history? You can also get dna from his parents (your grandparents) and it would show you were related. Maybe try appealing to his parents or any siblings he has.

I'm not sure that you can force anyone to take a test now that you are a grown adult. You should contact an attorney to find out or, ask this question in the legal section of Q & A to get a better idea.

You could take him to Court. It all depends on who your judge is. Sometimes they're nice and say what kind of a lame dad is he to not care about the welfare of his grandchild, but another judge might ask if you can provide proof of what the risks to your child is.

(does that make any sense?)

I'd say get a family law attorney that does free consultations. Run your questions and concerns past him/her, then go do your own proceedings in small claims (family court) if that's possible.

Or PRO BONO is what you'd want to hire an attorney at.

I think you're looking for excuses. How will a paternity test prove any potential hereditary risks? Forget it and focus on being a better parent than your father was.

Court system is your best answer. They can survive a warrant or some other item in that area to phone one. it works on some men when some women want to know if the last man she slept with is the babe's father or not.

Well a smart way to get them to take it without forcing them to do it is to just be around them when they spit (example: when the 2 of you are talking a walk he might spit on the ground). Then get a sample of his saliva and take it to the lab to get tested. Its sneaky but at least it cuts down the drama factor.

get a good family lawyer. If there is a way, they will know. You may have to go to court, but faced with that, your father may be willing to do it.
