how do I get back property from someone who's been evicted and I cannot find them and my property is still in the apt. but the management won't return my calls as I have left numerous messages for over two weeks now. The apts. are undergoing new management but there's NEVER anyone in the office. And haven't been able to reach anyone on the phone, just voicemail and no return calls back. I'm moving back to Mn. in a few more days and need my property. Can anyone tell me what I can do to resolve this quickly? Any and all advice is needed! Thank you

Seeing as you were no part of the lease they cant let you go back into the apartment. whats to stop you from taking something that is not yours? your word? Apartment communities do not go on your word. Unfortunately you are out your stuff.

Even if you get hold of the management co, I'd be surprised if they would let you have your property back, since it now belongs to them and they own the apt. They don't owe it to you, the only chance you might have is ask really nicely and maybe... but I doubt it.

Usually if they evict someone, they won't let the person they evict get the property, either, because they were evicted for a reason (usually not paying their rent).

You couldtake your ex-friend in small claims court for the value of the property. Gather receipts, any pictures or any other proof of the property being in their apt and hope for the best. Without lots of proof, that would be a hard one to win.

Probably the best thing to do is write this one off to experience and learn the lessons you can from it.

Legally you have the right to enter the property to retreive your possessions. Neither the landlord nor your friend has a right to keep them. Call your local sheriff's office, they can help you out. Otherwise, you may have a legit case for small claims court. Good luck!

I would suggest going to the apartment complex in person and taking any and all receipts showing that the property in question is yours.

call the local sherriff's department, and see what they tell you. not sure how this works in your state!
