I am 62 and he is vested at his work and can retire. Do I have to be retired to draw his benefits when he gets them

Either when he draws on them or your divorce decree should specify when you should get it.

If the divorce is final. You should immediatly contact the custodian of the retirment plan for the forms necessary to roll-over your share of the funds into an Individual Retirment Account (IRA), Once it is rolled-over, you may withdraw it in any manner you choose since you are over the mandatory 59 1/2 minimum age for penalty free withdrawals.

No, you don't have to be retired when he starts gettig his retirement. I'd contact the HR office at his work for info. Also, you can contact the SS Office.
