Because people are greedy and stupid at the same time, everytime you buy something, it should come with a 400 page book of what not to do with the product. If you buy a pencil it should come with the book and have stuff like, do not insert in anus, ears, nose, vagina. Do not stab yourself with it, others, run with it in your hands. Stupidity drives our legal system.

All of that is just CYA (Cover Your... you get the picture). I was reading the instructions for a smoke detector once, and it actually said "Device will not work if batteries are dead." OBVIOUSLY NOT. But they wouldn't put it there unless it had become an issue with some idiot out there.

No, just put a "you loose you pay" clause on all these lawsuits. I feel if you think you are going to make 15 million off a slip and fall accident that is proven your fault, why not seek damages from the individual who sued (wrongly) in the first place. People would stop filing so many. Frivolous lawsuits make me crazy.

Labels will not prevent "stupid lawsuits."

To provide you with an extremely oversimplified rule: a manufacturer is generally liable regardless of the amount product labeling as long as the plaintiff is a foreseeable plaintiff to whom a duty is owed, there is a breach of such duty, the plaintiff can show actual and proximate causation, and the plaintiff has suffered damages.

It's the juries who are awarding damages. So I'd say it's the general public that has to begin making the change to not rewarding stupidity.

There is the idea of contributory negligence, for example if you cut yourself with a knife it's not the knife's fault.
