Basically, whats to keep you from having a store every weekend?

Will the health department get in a fit if I sell burgers and dogs? Will the cops lock me up for selling beer? I think I just need to buy a vacant lot and open the flea market I've always wanted :)

You can't sell alcohol without a liquor license or you will be fined and/or jailed. You can't sell food without a permit from the FDA or will be fined and/or jailed. Yard sales are not regulated, because they do not include food or alcohol- just used "things" and you can have as many of those as you want and do not have to charge tax to customers or pay B&O (business and occupation) taxes on those sales.

Can you be a little more specific? Are you asking if there are restrictions on selling food at yard sales or if you have to charge sales tax?

For the tax side, I believe in general the states see it as a non-income producing activity, de minimis and do not require the seller to collect the tax.

Some local jurisdictions require permits for yard sales. As for the rest of your questions, be more specific.

right now you might still have some "plausible deniability" meaning you can claim you don't know - but if you really want to find out,, just visit your local cop station - they can fill you in - and put you on the watch list
