my wife called our neighbor and he said he did NOT give the landlord permission to enter his apartment and he was pissed.

she called our neighbor, who was at work, and he had no idea that the landlord was in his apartment!!
i don't want them in my apartment, thats why i am concerned...

under no circumstances should a landlord enter your building without an agreement in the lease pretainin to the maintenance and upkeep of the building.

Look upt your tenant rights by visiting either your city hall or online.

They can usually enter with notice OR if there is an emergency situation - you couldnt expect the landlord not to enter to fix a broken pipe that was flooding the building right? If that was not the case then it is difficult to prove in court, it happens often when the landlord is a jerk or there are other dispute going on.

It is legal for a landlord to enter an apartment for an emergency purpose without prior notification. They should leave a note stating why they entered and any repairs that were done.

this is illegal because when your landlord had "let" the apartment to your neighbor, he handed over the right of the property until such time that the payment or contract expires.. its either he is trespassing or your neighbor didn't pay the rent. If your neighbor didnt pay the rent, there should be a grace period given for him/her to come up with the money.. when it ends, she'he will be thrown out.

How do you know he didn't ask? Just because she "saw" this doesn't mean he didn't have prior approval. Our landlords let us know if there are inspections or anything coming up (in advance). Maybe the person renting asked them to check something out. Otherwise, no he should not be entering.

In my state, the landlord has to give notice before entering a tenant's apartment.

It depends, he is allowed to go to protect his property. Going in without asking is rude. Illegal? Probaly not. Check out your local Landlord/ Tenant laws to be sure.

If he didn't have permission, it's not legal. Talk to your neighbor, let them know what happened. It's up to them to decide what to do, it's their place.
