My bf and I are dealing w/ his ex who currently lives in tx. She has a one year old and about 4 months ago called us up and told us it was his and she would be fileing w/ the tx district attorney. She told us 3 months ago that the paperwork she be on its way to us. We havent heard from her in 2 months and I just sent her an IM asking her when we would be recieving something. She told me we would have to call the da's office. I asked her about a case number and she said that she had one, but we would have a different one? is that true? or is she just pulling our leg?

Your bf don't have to do anything until he gets the paperwork. Until the judge has signed the order, he doesn't owe any support.

One problem, however, is she might not have given the court his correct address. If the paperwork was filed, but he didn't receive it, she will get a default child support order against him. This would lead to him owing her child support, but him not paying it. If this happens, he'll quickly get into arrears and would have lots of legal problems. To keep this from happening, he should call the court where she lives and see if she has filed.

He needs to make sure that he requests a DNA paternity test to prove that he is the father. don't just take her word for it.

And one last piece of advise: Judges don't like it when the father's gf or wife comes in and says "we". It's not your case, it's your bf's. He needs to be the one to do the talking. Even if you help raise the child, you are a legal stranger to the child.

Good luck, and like I said, your boyfriend needs to insist upon a paternity test! The ex sounds really squirrelly.

In terms of child support, the State of Texas assigned all pertinent responsibilities to The Child Support Division of the Office of the Attorney General. The main function of this division is to assist parents in providing and obtaining support for their kids. This body receives funding from the state as well as the American federal government and represents the State of Texas and not individual claimants.

She pulling your leg. Don't have any more correspondence with this girl, she sounds like trouble trying to brew something up. If the Attorney General wants your bf, they know where to find you. Don't call any officials on her behalf. Let her implement the lie.

Good Luck!

She's either pulling your leg or she's ignorant to the fact...same case # and I would demand a paternity test prior to signing anything
