My ex husband owes a couple of thousand of dollars in back support, today I went to friend of the court to have them help me collect it. They told me because I was not receiving welfare that there is a no enforcement policy when someone is recieving SSI! Is this true has anyone else heard of such crap? If this is not true how can I fight Friend of the Court decision?

DOG WALKER-- If you read the question you would see that it reads that I am not recieving anything from the state because I have worked since my daughter has been born full time. I am the pay that pays for her to be day care, her clothes, her school stuff, he doesn't do anything for his child. It is not the point of me needing the money, I could care less, but I think he needs to be resposible for her too.

I work full time. I do not NEED his support, but I think he should be also responsible for creating this child.

Wait. Are you getting SSI or your ex? If he is then they can't take his SSI for your child support. SSI is not considered income for spousal or child support.

Whether you are getting welfare or not shouldn't matter. It's what he owes to you that matters, so if he gets any income other than SSI they should go after it whatever your financial situation is. Call DSS again and talk to a supervisor or director or commissioner. Call a local social service agency to help you advocate for yourself. Make sure you have your ex's address and his social security number too.

My ex is getting SSI and I am collecting child support from him. It is not much, but he is court ordered to pay me. He is responsible for his kid no matter what kind of income he has or doesn't have. It does not matter how much money you make. He still has to pay. My son is 10 and he never helped me out until this past year when we went to court. So yes, you can get child support from him.

That's a bunch of crap, you're right. It has nothing to do with it. Who is Friend of the Court? I have never heard of them. I collected SSI and got support before, and it had to do with my income, not the SSI.

check with your local office it should nnot matter who is getting ssi there is a child involved the money is for the child not the parent
