If you are an independent contractor with a contract, I believe that the contract dictates whether or not the vendor (NOT employer) can mandate a drug test. HOWEVER, if you don't have a contract or if the contract makes it easy for your services to be discontinued with little or no cause, saying NO to (or even simply resisting) a drug test could put you out of work.

Yes they can. Being an independent just means you pay your own taxes and so on. As long as they sign your paycheck, you have to take the test if they require it. There are ways to beat the tests I've been told...

i have seen it done plenty in real estate- because you are still representing the company's name and reputation. You might be entitled to refuse -but they may discontinue the hiring process
