you would have a better chance of getting this answered by someone who knows the correct answer if you put it in a the section called Politics and Government and then went into Law Enforcement and Police

It's up to the police or crown to decide if they want to go ahead with charges. It's their call not the victim's. In a case of domestic violence they will proceed with charges even if the victim is uncooperative.
