would the child be a Mexican citizen, or a U.S. citizen? The mother and child are in Mexico, and she does not wish to come to the U.S.

Also, would child support be calculated by wages, or by cost of living in Mexico?

He would be a Mexican citizen by default, since he is living IN Mexico and is a son of a Mexican citizen. It does not matter who the father is. She can be a single-mom for all they care.

HOWEVER, he can is ALSO an american citizneh Through birth abroad to ONE United States citizen IF all of the following are true:

1. One of his parents was a U.S. citizen when he was born;
2. His citizen parent lived at least 5 years in the United States before he was born; and
3. At least 2 of these 5 years in the United States were after his
citizen parent's 14th birthday*.

His record of birth abroad, if registered with a U.S. consulate or embassy, is proof of his citizenship. He may also apply for a passport to have your citizenship recognized. If he needs additional proof of his citizenship, he may file an "Application for Certificate of Citizenship" (Form N-600) with USCIS to get a Certificate of Citizenship.

*If he were born before November 14, 1986, he is a citizen if his U.S. citizen parent lived in the United States for at least 10 years and 5 of those years in the United States were after his citizen parent's 14th birthday.

If that is the case, the child would be born abroad of an America parent.

The birth would have to be registered with the consulate to establish US citizenship. Dual citizenship is a trickier matter.

Child support would be determined by both what the father can pay and what the child needs.

The child would be mexican citizen. You would have to go through the same process to get him in this country as anyone else in mexico. that happened to my brother.

The child would be a citizen of whichever county s/he was born in. The child support would be calculated by whichever country's courts had the hearing. In the US, it would probably be calculated by American standards.
