He has a wife and one child with his wife, there has been no divorce or leagal separation. He has no other children. The child support commitee is looking for him he just found out today. Does he owe them anything for the daycare assistance his wife recived while he was in jail? If his wife is trying to get child support from him without filing a divorce, can she do that?

Well, first of all, I use to work for CSE (Child Support Enforcement). If he has been in jail, and their is no legal seperation or divorce and no papers has been filed then no. Second, he might want to research his rights to see what grounds he needs to stand on as far as any kind of support to his daughter. Also, he just got out of the slammer, he has to regroup. And it takes more than five minutes to get going again. So, unless he has the courts riding his back, then he is free at this time to not worry, in my opinion. What is going to be is going to be, and once the paper and pens gets pushed then he should worry. Tell your friend to get focused and whatever he did to get himself thrown behind bars, throw those shoes out and slip on another pair. Everyone deserves a chance to redeem themselves. Everyone on this earth gets another chance everday to do better, that is the chance God gives us to do right. Good Luck to your friend.

There is no such a thing as child support when there's no divorce or legal separation. However, his wife may have filed without his knkowledge and obtained rights to child support. Jail or not, the law says you must afford your children the best you can materially. And the law will be enforced.

If the child support committee is looking for him then he owes child support. If he has been in jail then that can be considered a legal separation, it just depends how long he has been in jail for. In my state, legal separation before divorce is six months, I don't know what it is in Oklahoma. However, since he has been in jail, I doubt they will put him back in jail or non-payment rather they will likely go to arbitration to work out some payment agreement.

My boyfriend currently receives child support from the mother of his 4 year old daughter. She did not pay for 6 months and got arrested then she had to pay half of what she owed in back child Support so she could get out of jail. Now they take the money out of her paycheck.. Shes a dead beat mom..

I'm not really sure but even if he was in jail he still has to support his child. Its not the child fault that the dad was in jail so why should the child suffer for his dads mistakes.

Ohhhh! They looking for deadbeat. They don't care what there situation is. Just like bill collecter. Not only do he still have to pay but back pay to. Divorce or not. Tell her get that bank account ready. Because she will be rolling in the dough.

I say he needs a lawyer pronto. Or he may end up back in jail it is possible to work out an agreement that he pay so much a month to get it caught.

she didnt have to according to laws in florida your way over there my guesse is its pretty much standard if a woman ask for state assitance then the must try to recoop their loses and seek it through him... he has a loop hole but would need to see an attorney locally . they can only garnish according to his wagesand being in jail im assuming he didnt make to much money. but the collections for c/s will try to get a judgement any how ... hence the reason for an attorney good luck

If there is a legal separation...yes

If she posted in the paper, the announcement of divorce and he did not respond. And it was granted....yes

Honey...loose him until he cleans up his act...so many more fish out there.

i can tell you from personal experience yes he owes child support he needs to start paying something before he gets too far behind....
