Harley Davidson MEANS not having to ask for permission!

The organization who is manufacturing the stools needs the approval - presumably this is a stock product that they offer.

If on the other hand you provided artwork that was downloaded off the web (or something) and you are having these stools created in some guys basement, then I doubt Harley is going to have to much to say about it but to be certain you can contact them via their web site and see what happens.

It may not be safe to assume that HD had licensed their logo/trademark to the manufacturer of the stools, especially given the amount of counterfeiting that goes on.

Even so, you've already bought the stools. I'd say go ahead and use them unless/until you get a cease/desist letter from HD's legal department.

Bottom line, it's unlikely that they'd be bothered if you were using officially licensed HD merchandise as furniture. Certainly, they would ask you to stop using them before they would hit you up for damages, so it seems like it would be a safe bet.

However, if you incorporate HD into the entire decor, and name your Cafe the HD Cafe, they may get considerably more interested in your enterprise.

Good luck,
Rex

I am no expert in this area but it seems to me that if you bought the stools they are now yours. Beside I'm sure Harley Davidson wouldn't mind the free publicity.

However built the stools got permission from Harley. If you bought them, you can do whatever you'd like with them. They are yours now.

No, you do not need to notify HD Corp. You are not using them for advertising, right? If they are to be used in your cafe as furniture, or even just as decoration, there is no problem. Besides, HD got their royalties when you bought the bar stools.

I would send them an e-mail or letter and ask them. I doubt if you can rely on any claims from someone online who have no stake in the "verdict".
