If you are still legally married, he can not easily file kidnapping charges against you for a vacation.
If you were divorced with shared custody, he could very easily file kidnapping charges.

How is it kidnapping? If no papers are filed, he is still your husband not your owner. It doesn't matter if he is under the same roof our not. If what you say is true, he sounds like he is just trying to intimidate you to control you. There are no written agreements, so enjoy your vacation. Send him a post card.

No, he can't. If there are no documents filed giving orders, then you can do what you want. But so can he.

If it's a vacation, go for it, the kids will love it.

If you're planning on running away with the kids, don't do it. The only people you'd be hurting are the kids.

I do not practice in tennesee, but I would ask you how long you are expecting to be out of state on vacation. Months there might be a problem. If you are going on a brief vacation, and there is no adjudication of custody, you should be fine

He can report you, yes. It's less likely that anything will come of it. A lawyer might suggest you not take the vacation until after the divorce papers are finalized. It would look better at your divorce trial.

if no papers on custody filed, then either one of you can take the children anywheres for as long as you want. And especially just for vacation.

Well it depends on who is the legal quardian of your children. If you are then he wouldn't be able to do anything about it, because you kidnap your own children. And even if they were under his care if you had a verbal consent from him then it would also be alright.

Does he have legal custody??? If so, as soon as you leave the state,, he can file..... technically.....

If it is just for a vacation..... then try and explain it so nothing will be misunderstood....

If it is for other reasons...... I dont want to know.!!!!!!
