There were some pretty big lawsuits over this exact question a few years ago. I don't remember the outcome, but it should be pretty easy to find with a few searches.
As has been mentioned, you need to make sure that the fact that you are a man is their only basis for not hiring you. To be honest, if you write or speak as you have typed this question, it would be failry easy for them to cite a lack of communication skills as the reason for not hiring you. I say this not to be mean, but because it would certainly be one of their defenses. Besides, even if the reason is the fact that you are a man, they can simply say that they felt another candidate was more qualified for the position. Winning a discrimination suit like this, whether it is Hooters or some other company, is pretty difficult to do. In many cases, you could nearly say impossible.

Yes, it's discrimination, but you have to remember one thing: "Hooters" does not refer to any part of a man's body.
Sometimes, you just have to leave it alone, man. Why don't you start a restaurant where guys walk around in tight shorts? I'm pretty sure there's a market for that.

What if the restaurant was called "Cuisine By Females". One which specialized in dishes from all over the world, served up by female Chefs. Why ever would you want to apply there, knowing fully well that you'd never get a position based on the obvious fact that you're a man?
