i asked my son to sign over temp custody and he doesnt want too he wants to give tlhe baby to whoever he wants too i ve been taking care of the baby since january she is nine months old

You need to consult a family lawyer, and probably file papers to get custody.
Where is the mother? Mothers family?
How long will your son be in jail?
Who had child before you did?
The court will consider all of these things.
Consult a lawyer ASAP.

if you have been the one taking care of the child, then you should be able to either go to a lawyer and see, or either talk to your state family services to see if you can get temporary custody. Good Luck
