I would definitely go through the court system to get Guardian ship..

Is he in a county jail or a State Prision. How long will he be there. These things have to be considered. Get a lawyer to sort these things out. The lawyer will do all the legal things. Then it will be up to the judge to decide if you can take custody away from your son. By the way where is the mother? She will have to be contacted. She also has to give up her perental custody.
You may be in for a long battle .

Ummm... Where is mom... If both are in jail, it's not as hard to try to claim custody... If mom is there... it'll take a good amount of money for the lawyer... tried in the right county... with the right judge to get a male gaurdianship... especially with it being the grandparent when the mother is there to take care of....
I'd start talking and seeing how much lawyers are in your area if your seirous in this matter

Call a lawyer and tell them what you want. Set up and appointment to see what needs to be done in your area. He should know everyone to contact. If you call social services, will they come and take the child? or leave it with you? If its only a consultation, there may not be a fee.

So whats issue? You have the child. Are you trying to say your son is an unfit parent? If so go to Family court and petion them to make you legal guardian

i would call the social services office and talk to a social worker...they should be able to point you in the right direction and be able to tell you the legal way to go about it
