Seriously. When men takes off with the kids, it's kidnapping but when women leave and take the kids it's just fine? Why is that?

Y'all aren't getting me here. First- I'm not married and don't have children so this question is hypothetical. It was about the double standard that women can leave and take off with the kids, but if a man does it, it's unacceptable. I want someone to explain this paradigm.

It all depends on the situation. No matter what if there is a stated agreement about when the kids will be dropped off or whatever it can be construed as kidnapping if the children aren't returned. If someone fears for their saftey (man or woman) and the saftey of their children, it can easily be explained if the reasoning is there. Again all on the situation, but if you use the children against one another that's not fair to the children. Be adults and try and get along through this difficult process.

Actually, both cases are technically kidnapping if the spouse just disappears with the kids without the other's consent. If, however, the spouse goes through the legal channel of seperation and/or divorce, the court awards custody "appropriately." Mothers recieve custody in the large majority of cases, and this is not kidnapping.

It's not kidnapping unless there is a court order preventing him from leaving with the kids. Same goes for women.

Its actually not for either party custody has to be set by the court.Taking your child prior to a separation is not kidnapping for either party as both parents have physical custody.

Remember that phrase during your wedding, "til death do us part?" Well, then you already know what you're talking about could never happen, because there is no leaving. You either stay married and work things out, or one of you should be dead. If you didn't leave "til death" in the wedding vows, then it's your own problem.

Actually, custody is usually determined by a court order. If the non-custodial parent does not have ordered custody or visitation, then he or she has no right to take the children.

because the woman is the person that held the child for 9 months and pushed it out into this world.

ITS ONLY KIDNAPPING IF LEGAL CUSTODY HAS BEEN ESTABLISHED OR IF THE CHILDREN ARE BEING HIDDEN AND THE SPOUSE DOESNT KNOW WHERE THEY ARE OR NOT ALLOWED TO SEE THEM. THEY GOES FOR MALE OR FEMALE.

Eight years ago I told my wife to leave. She told the kids to follow her. And I told them to sit down this is their house and i told their mother to leave. Kept them myself. Made her pay child support. It happens.
