No. If you killed someone and didn't get caught, is it legal? If you robbed a store and didn't get caught, is it legal?

If something is illegal, it's illegal no matter what the circumstances. Getting caught means the law caught the perpetrator and they will more than likely pay the price.

Of course it did. And of course the action is still illegal. The person who broke law simply hasn't been charged with or convicted of doing so yet.
