This has a few caveats;
Are all three of you US citizens? If yes is there a custody award for the child? As long as you are the custodial parent, you may take the child out of state unless you are also the conservator or guardian. If this is the case you must let the courts know. No, as long as you have all the documents like a passport and possibly a visa, then you can come to the US. You will never need permission from anyone except our government to come to the US.
