I need to file a divorce as soon as possible, I live in Wichita Kansas and am trying to divorce abusive husband, I am not able to pay for an Attorney at this point in time but I need to do this ASAP, so where do I go from here?

Step one is you find a shelter for abused women and go there. Check with the county to find one. Then you start planning your next steps with some help and being in a safer place.

IN Kansas you can go to the court and petition for divorce. I am not sure of the filing fee, but in 98 it was $35. This only works for NON-contested divorce. So if there is a chance that your husband will contest this divorce and try to stop it, you will go through a lot more in court and will probably need an attorney. You should also consider an attorney if you are concerned about child support, property, etc.

If you need an attorney, your local court may be able to refer you to an attorney that is based on your income. I would call and ask them about that. I know Manhattan Kansas has a program for lower income situations.

A divorce in Kansas takes 90 days from the time you file to be final. As for Protection from abuse orders, go to the local courthouse and file for that as well. It is not that expensive, and you can file for those even before filing for divorce.

You can do it on your own but they make it hard to get all the information and forms right.

There may be things that you need legal advice for to avoid getting a bad deal your didn't even know you were getting into. Mediators and legal assistants might be an affordable choice.

Otherwise you need to do a lot of reading on your own that might be difficult to understand for a non-legal expert. You may also want to visit a divorce support group where you might find an "expert" help.

Your Local bar is sure to have a program to help you with pro-bono or low bono legal help. I bet your county also has a legal aid office, try a women's shelter first, get away from the abuser first, then seek further help. It would probably be smarter to have him arrested and get a restraining order which forces him out of the house. Then you will be holding the cards,Please don't do this if the guy isn't really beating you.

How it works QueenBea (odd name for a man) is she has to pay for a DNA test $300. if the test proves your the dad then she has to procure a lawyer and he takes that and files a petition for back support for those years. The judge determines if you are in fact the dad and determines the amount and then you can have a payment schedule to pay on each month. This will go through the child support division for the state so you get credit each month. But she is looking at spending some bucks to get this going.

Go to the County Clerk's office, they should have aa divorce packet with all the papers you need. They caan't answer any legal questions but may\be able to guide you through the papers

I think every state has "Dissolution of Marriage" That can be simple or complicated. The spouses have to agree on everything. Disputes require an attorney, especially with children involved.

First i would phone some local attorneys and ask them what you need to do. I'm sure they will direct you where and what you need to do.... Good luck girl and if you need to leave seek a women's shelter....they will also be helpful I presume.......
