I have joint custody of my 5 year old son and his dad only has visitation. I was wondering if my ex could stop me from moving out of state to live with my new husband. I told my ex he could see his son when ever he wanted and that I would drop the child support. Please help me I want to be with my husband and be a family. I also have a 9 months old daughter that can't be with her daddy because my ex is stopping me from moving.

If you have joint custody, and not full custody, your husband probably does have the right to stop you. You could go to court and try to get full custody, with visitation rights given to the father, but you probably aren't allowed to move him out of state without either the consent of your ex or a new court order pertaining to your custody agreement.
I feel for you and your new husband, but think about how you would feel if your husband wanted to take your son out of the state.

Yes he can stop you from moving out of state because you have joint custody though you may have residential rights (the right to decide where your son lives IN STATE). Unfortunetly if I were your ex and you told me that child support would be dropped and I could see my child any time, the moment you get pissed off those conditions would go away. I would be TOTALLY oppossed to you moving.
You have two ex's to deal with to move out of state. Ain't going to happen.

Well, you should look at it both ways. Put yourself in his shoes. How far away are you talking about? This is something you really need to sit and talk about with your current husband and your ex as well. There are a lot of emotions here. Plus, your son needs to bond with his dad, especially if he is being a good dad to him. If you cannot come up with an agreement, then you're going to have to let the courts decide, which would be a very sad thing to do being that the courts are so cold and they don't know anything about you or your family.
I hope you come up with an agreement with your ex. It's your son you have to take into account here. It's not his fault that you and his dad didn't work out, and that you remarried. I wish you lots of luck with this decision. I know it must be heart wrenching.

there is no way you can stop child support. you can move out of state but must show the judge that you are not just doing it to get away from your hubby, if you tell him that you have nothing in that state and want to go back home, or your hubby is changing jobs if he is in the military thats even better, but you also have tio have aplan set for you ex,meaning transportation and stuff like that. think it might work. good luck.

Unless it says in your court papers , You can live your life anyway you feel it needs , moving for employment , lifestyle or housing . My ex wanted to leave years ago and my lawyer said I could do nothing but visit .

My Dad moved from Maryland to Florida and he could see me and my brother when ever he felt like traveling so I dont see how anybody can keep you from moving. This is a free country.
