Robbery is defined by theft while the owners or business in this case is open and your doing it from someone like a teller. Burglary would be without them knowing or after hours. Pens are left out for customer use and if your a customer then have at it....

No, then it would be petit larceny. Larceny and Robbery are 2 different things. Now, if you stole the pen off the BODY of a worker, then it would be robbery. =)

If I stole a pen, then owned it... Not just mistakenly forgetting I took it, and then returned it-- STATING exactly that I stole it, it was mine... and now I'm giving it to you, the institution I stole it from, merely by whim and chance, but moreover Charitably... should I be arrested or praised?
