Who has the child? If she has the kid and hasn't had any problems, leave it alone. Why do you want custody if she's a good Mom? That would be a barrier that would cause it never being possible to reconcile the marriage.

Sure, but what exactly do you mean by a good mom "figure"? Take custody of your son. Obviously, if she were a good mother she would've taken the son with her when she left you. Or maybe there's another plan in the making. Who knows. It sounds like there's a lot of dependency on her on your part. But the way I see it, you'll move to California. Before you do that though, try to see if she'll move back to you. A person that loved another would try to make it work again. I'll tell you the same thing I told my son "Don't play the fool". G- Luck.

Pick and Choose your battles wisely! just wait until your child is of age to decide who he wants to be with. a child needs both parents in his life, but if he is young then he should stay with his mother, in the home he is in, and the environment he is used to. if you take a child from all these things for your selfish concern and desires it would damage him in the long run. Just think of whats best for him right now not you. I know its hard as a parent to put all your needs and wants aside to look out for their best interest. good luck to you but dont start something thats going to majorly effect your child.
