A former friend(a police officer) charged up my credit card without permission and is barely making minimal payments, which is wreaking havoc on my A+ credit history. I'm trying to avoid having to file a report against the friend.

Suggest you file a report along with proof if you have it. He's an idiot if he's a cop and did this.

Otherwise, look for a form called a "Promissary Note" and note an interest rate, payment and date it is due in full. If he owns property, which I doubt, secure it and have a title company do papers for a mortgage and note on the real estate.

I don't know your state, but if you have doubts, have an attorney help, get two witnesses and have notorized.

You can get a simple repayment agreement at any local office supply store.

Now this still does not mean he will pay, he will just legally owe you.

Next if you let him use it, he did nothing illegal, and merley not paying you is civil at this point, not criminal

Write up the contract and have a notary of republic sign it with the stamp. That should do it.

It can be as simple as

Date

I His name owe Your Name $ xxx I agree to pay $ xxx per week/month on the x of each month/week in xx installments. If l am late I will pay a fee of x % for late payments.


You can add interest if you want and have him sign it. and you sign it.

Signed You Signed Him

If he doesn't want to sign you can turn him in.

i agree with the 1st answer, did u give this person permission or no?? b/c if u did then u have no case!! if he did it without permission, then u gotta prove it which is hard to prove esp. if he says that u did! good luck.
