I was arrested for a warrant for a stolen bass guitar. The Charge was theft of $850. The bass was in my possession, leant to me by my brother. My sister n law thought I had stolen it and called the police on me. My brother explained the situation to my sister n law and the police. The police then thought it was just a case of mistaken thoughts due to my sister n law. thus decided to let it go and I did return the bass. hen I was riding around one night my freind got pulled over and I went to jail for the warrant. My lawer and my brother pleaded with the D.A. of Wichita Falls that it was a mistake. The D. A. ignored the pleas and prosicuted me. I had no way of bailing my self out.so I was either to plead guitly with time served or stay in jail for another 8 months or so for a court date. I chose to plead guilty .because I could not stand sitting in Jail. I thought we could clear this up.Now its on my record.I feel its ruined my life and I want this cleared. But I have no money. Help!

You plead guilty, so you can't get this off your record.

You should have requested a jury trial, and then your brother and sister-in-law should have testified for your side about the mistake. Neither a judge nor a jury would not have convicted you if the victims testified on your behalf..

Sorry - you're out of luck. You gave up your rights when you pleaded guilty, even though it was the lesser of two evils at the time for you.

The only thing you can do at this point is go back to court to have the charge lowered to a misdemeanor and then possibly expunged. You DO need an attorney to do this for you however. If you had a public defender, you can contact their office about working with you on this, but it is really up to them.

You have admitted your guilt in a court of law.

I would think it would be difficult to appeal at this time.
