My Dumbass Brother met this syco-**** & sence then She's got a restraining order to stay way 50 feet etc
BUTshe plays him like a puppet on a string and having him with her and her with him and claimed she was just angry when she got the order and was going to withheld it from court. NOT!!!!! Now my bro is in Jail for 90 days. She was missleading him and set his azz up for this! He lost his job (which was a goverment job) and his apt., his child (custody-parent) My brothers only crime was his ignorace and his pee pee!
What burns my butt is that she can pick & choose when & where to inforce the order and to incriminate her choices of being with my bro. Sabotage my puzzy whipped brother to the point of destroying his life as far. Im so angry @ this system for allowing such cheap trash to play a control games in her favor.
Now shes calling the jail for him!!! Is there a law for her of break her own rulings of stay away?? This is all filed in Santa Clara Co. Ca. Is there anything?

I think he could file harassment papers against her. If she is calling the jail they most likely have a record of it. Tell your brother not to be so dumb next time. Those restraining orders mean business and it stays in effect until the time period lapses or the person who took it out ends it. As far as her breaking the restraining order, you would have to check your local authorities for that. I know where I live that if I take out a restraining order and violate the terms, it is no longer valid. In other words, the minute she approached your brother and made advances to him, the document would be void. Call your local court house and find out. Or the police. They can tell you.

Tell your brother that next time he is in a relationship find out what his girlfriend is all about. There are a lot of psychopaths out there, and they love to play games. To answer your question, she can get in trouble if she violates the terms as well. My friend had an order against her, and the person who filed it violated and got a day in jail.

The burden of proof is against him, he has to obey an order of restraint once it is served to him. He should have had it thrown out before getting involved with her again.

It is generally pretty hard to get a restraining order, so it seems that much of this story is missing.

If she has a restraining order, it is up to your brother to follow it as well, not just her. He violates it if he chooses to come within "x" number of feet of her, and he knows the consequences. I know that sounds harsh, but he unfortunately is learning his lesson the hard way.

a restraining order works both ways she is also barred legally from contacting him, next time she calls him he should contact the prosecuters office in which it was issued,

now first time they probably will do nothing but if she continues to call he shoudl report the violation each time to establish a pattern
