I have been living with the mother of my kids for 5 years we never got married, our relationship went down 3 years ago mostly fights and arguments. I started going out with someone else 1 year ago, i never told her anything about it. I never neglected my kids i was always there for my kids and their mom but just recently she found out i was seeing another woman. she is telling me that she is taking full custody of the kids because of infidelity i would understand it if we were married but we are not. can she use that as a reason to take the kids away from me? please help anyone,

Unless you are a child/wife beater you have the right to see and be with your children.....If you have no money go to legal services and ask for help....you can also go to the Family Court in your County Courthouse and file a petition for joint custody. I hope this helps....

a mom can get full custody very easliy the court feel that the kids should be with thier mom BUT she can't stop you from seeing them just for being with someone else if you are a good dad you have nothing to worry about . See if your state has joint custody. just remember to keep the kids best interest at heart. do your best to not let them get hurt.
