When I divorced my husband, the judge told me I could use whatever name I wanted as long as it wasn't for unlawful purposes. He explained that people marry, divorce and marry someone else. Names change anyway, so they don't object to restoring a maiden name.

If you are a husband wanting to take your name back, ask nicely maybe she will change it, but you can't force her.

From experience, I've found it's best to keep the husband's name if you have school age children. All those different names makes paperwork confusing.

No, a woman can go by whatever name she wants and the court can't make the woman change it just because the soon to be former husband wants her to. A person can legally change their name for what ever reason. The ex-spouse might want to keep her ex-husbands name because she has an established professional career that everyone knows her by that name so it would be a reason for her to keep it.

If you're asking whether a woman can change her name back to her maiden name after a divorce she certainly can. In fact, after a divorce in many states a woman can actually change her last name to anything she wants. An old work colleague of mine had a divorce and rather than going back to her maiden name decided to change her last name to "Christian" in order to reflect her faith.

the woman can say in the hearing if she wants to keep married name or go back to maiden but the husband can't make the choice. if there are kids invloved then she should keep the same name as them .

Not unless the wife wants her name changed back.Otherwise she can keep the husbands name if she wants.I know this because my husbands ex-wife still has his last name,drove me crazy at first,but hey she is no longer in the picture so she can call herself whatever she wants.Hope this helps.Good luck,God bless:O)

A woman can keep her married name or revert back to her maiden name. It is her chlice and nothing to stop that unless you copywrite your name or something which would probably be impossible.

You can not force your ex wife to change her name. She can do it if she wants to, but you will not be able to force her into it.
