I told finance company 2001 that she is rewarded the car. They sent her payment book in her nameThey would not put the car in her name because she has BAD credit. Even though the divorce decree ordered me to do so) Now years later, the finance company trying to come after me. I moved to another State. Is everyone telling me I have to go back to that State in orger to sue her for this debt she created? Any information is appreciated.

Been here done that - courts can award the car to her - but they can not transfer responsiblity for paying the finance company - if there is wording that she is to pay for it in the divorce - than all you have is a contempt of court action against her - all you can do is reach some type of payment arrangment with the finacne company - I fought it all the way and it still came down to I had to pay because it is financed in my name - you can pay legal fees to fight it - do what I should have done - use the legal fee's you will spend to pay the fiance company - if you are nice about paying they will work with you to get the late payment fee's eliminated - and not report it as bad on your credit - good luck

The finance company is doing whatever they can to collect the debt. Let them come after you. They have no basis to collect the debt.

Your main concern is to keep your credit report clear. Therefore get a copy of your credit report and write a protest letter to any agencies that are listing this as a bad debt. Supply a copy of your divorce decree. After it gets cleared be vigilant about monitoring your report thereafter...the finance company might submit it as a bad debt again and again.

If this problem does not show up on your credit report, it is truly not your problem. Write a letter to the finance company explaining the circumstances and be done with it. If they don't cease and desist then hire a lawyer to make them go away.

Are you able to contact this lawyer about this? It would be great if so. A lot of times these company's don't keep all the information on hand they might need in the future. Bad credit or not if this was decided back then by the divorce decree then they need to do their homework. Best of luck to you!

Get a good lawyer this is a lot of crap. This should have been taken care of at the time of the divorce. My husbands was concerning his daughters education and if it was not then too bad . If they make good grades then they can go to school on grants or some other programs. The ex needs to get real and deal with her problems on her own. Who does she think she is? She is a part of his past and should stay there.

a divorce decree is a legal document signed by a judge and they must obey it.you are off the hook, you aint gotta go nowhere, fax them a copy of the divorce decree and tell him if they dont wanna obey then when they sue you then you will file a counter claim for harrassement because they callin you bothering you and you gave them legal documents saying you were off the hook, tell them they should have repossesed the car and tough crap.if she was told to pay then even if it was your car origanlly u are good

If the car loan was originally yours yes they can still come after you, not matter what the court order says. You would have to pay the car dealer and than you go after the ex. I do not know if you would have to go back to her state or not
I have dealt with this on cell phone bills many times.

Unfortunately they can still come after you. The divorce decree gives you a right to to after your spouse for any amounts you are forced to pay out.

I thought in a divorce there is no liability for each other's debts? Talk to a lawyer. This shouldn't be on you.
