It depends on the health laws State by State. Some States allow restaurants to donate specific non temperature regulated foods. However most things that are left over like Soups, Salads side veggies etc would not be applicable. I worked in many different restaurants for over 15 years and the waste at the end of night was disappointing. Baked goods such as bread and cookies or any bottled water or can goods can be donated but not the obvious stuff that is tossed every night..

Actually I know of one chain restaurant that does provide food to the homeless. It may not be considered "fast food", but Panera Bread Company donates their baked goods that do not sell by the end of the day to homeless shelters in their respective cities and towns. I believe this sort of thing can be done by more restaurants and companies, and can avoid begging by the homeless, by simply delivering their left over/non purchased food items to a local shelter or ministry that will distribute the food for them. Kudos to Panera for thinking of others....even after they've made a hefty profit!

Restaurants or other food vendors will not provide their unused food or food past the expiration dates to homeless people or shelters because if someone gets sick they will sue the company. The companies do not want the liability.

It does happen in some cities. Some places have a food bank from left over food from all the restaurants that participate. It is picked up every night from the various restaurants. It is a great idea. Maybe your question will initiate some action!

It`s the case of one bad apple spoiling the whole bunch !!!
I was told by my employer, the reason being,
during the time food was given to the homeless, there was a case of food poisoning. The company was sued for a large amount.Hence, no free food for the homeless.

Unfortunately, it is about the money. Not necessarily the restaurants money. In Texas it is illegal to dumpster dive. Grocery stores cannot even throw out produce not good enough to sell or dented cans. Because of the fact someone may sue them if they got food poisoning. The same goes for restaurants all though they do throw it out. But they are afraid if they actually do something good for someone they may get sued. Outrageous at it may seem, someone may actually sue them.

It is services paid for. We the tax payer pay the government to provide those things in our time of need. When you go to a store, don't you expect a good to be provided when you pay for it?
