She needs my approval and signature before she can get off the lease and I told her I will not approve unless we find a replacement I am willing to live with. I told her she will have to pay her part of the rent until we do so. Am I allowed to do this? Are there anymore suggestions on what I can or should do?

My room mate decided to tell me friday night that she will be moving out the next day. We have a lease on our apartment until mid January. She has paid for July but says she found a room mate to replace her. Do I HAVE to take this person even if I don't approve of them? I am a young non-smoking college girl and the person she is having replace her is a 24 year old MALE smoker. He is really gross and used to be on drugs. (I don't know if he does them anymore) Do I have to just accept anyone to replace her on the lease(if he gets approved by the apartment complex) or am I allowed to be a little picky?

No, you do NOT have to accept just anyone as a proposed roommate. Due to the intimate nature of having a roommate, you may legally dictate the gender and personal habits of a prospective roommate. In most jurisdictions you may also dictate certain factors that are normally protected by law such as race, sexual preference, creed, or national origin.

You and your current roommate are both liable for payment of the rent on the apartment. In theory you might be able to force her to pay her fair share until you locate a suitable substitute. You'd have to file suit, probably in Small Claims Court, to force her to pay up if she does not willingly do so.

You are totally correct. Your roomate made a promise to pay 1/2 of the rent for the lease term. Who you live with is VERY important, and you are totally justified in asking her to pay until YOU find a roomate you want to live with. I have had to do this, and luckily my roommate understood.

You need to be picky about roommates!

I'd tell her HELL NO. The most you should do is help her find you a new roommate, but until then she owes 50 percent rent.

no and your present roomate is responsible for her share of the rent until you find a roomate of your choice preferably another non smoking female
