No. I would imagine that immediate recusal should be appropriate in that situation. However, if not, it would open that judge up to reversal (in states with two levels of appeals courts) or a possible ethics complaint.

Not if they have anything to do with the case she is sitting on. She has to recuse herself just like one of the Supremes did in the Gitmo case as he was the appeals judge!

The Supreme Court overturned his ruling!!

No way. If I believe I am right, reviewing my prior decision is not going to change my opinion. It should be passed to peers.
