Had engine problems on the freeway and called AAA and they sent a towing service that cause damage to my car and I want to take them to small claims and get it fixed.

Contact AAA. They are committed to their customers and will do an investigation themselves. If they find in your favor, AAA will force the tow company to either repair or pay for repairs. The contractor will generally do what it takes to keep their AAA contract. However, if the contractor doesn't like the outcome of the investigation, they can appeal to a small claims court just like you can. Start with AAA, and get your story straight. The more forthright you are with them, the better your chances of a fix.

I would think you would have a difficult time making a case against AAA. You have have to show that the damage to your car was a direct result of either malice or neglect by the person who made the phone call for you. The AAA itself did not tow your car, they have agreements with towing companies that do that service for them.

I would make a claim against the towing company.

you take the towing company to court, but contact AAA they might have a way to help you get your car fixed. Maybe it is part of the service.

You can only sue the towing company that came and towed the car
