Has the court awarded custody to the mother? You can take her to court and ask for joint or full custody. The judge will look at both sides and make a decision that is in the best interests of the baby.

The question I have is why don't you have custody now?If you were a responsible dad, the court should have at the least awarded joint custody.

However, the only way to get custody is to go back to court and request it, be aware though, if the mother shows she is a fit mother, the court will allow joint custody, sole custody is one of those things people get when one of the spouse's are grossly unfit, an abusive parent, uses drugs, spends at least a week in jail , has a DWI and or continues to drink etc etc. Also custody of a child is more often awarded to the mother, because it is felt the child is her blood relative, and children according to psychologists need the mother more than the dad.

Get a GOOD attorney, if you are set on doing this and set aside a lot of money, because you will need it.

Yes, dad can take custody of his baby as a natural guardian. in case the wife is not fit and for well being of the child if both husband and wife are separate whatever is the reason. if father is in good financial position and have his family like parents and any other elder members in his family.

Its a difficult road through the courts but more men are achieving it these days. Be strong, never lose sight of your love for your baby, find other men who have done this and ask their advice, get your parents on-side, don't buy into the anti-male hype. Responsible dads are so important. All the best.

this is a court question. the responsible dad should go to court and talk to an attorney about this. assuming the mother is unfit to take care of baby

It's difficult, courts favor the mom. Not always the best for the child... Look in you local yellow pages directory there's always lawyers catering to dad's. Good Luck! Never give up :)

If he is responcible he should already have custody.Unless some skank did'nt tell him he was a father.
